Storeflea Mart Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of Storeflea Mart, the online shop-discovery marketplace available at shopping.storeflea.com and the Storeflea Mart app (the "Platform"), operated by Storeflea ("Storeflea", "we", "us", "our"). Storeflea Mart is a product of Storeflea. By using the Platform you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under Indian law to use Storeflea Mart. By using the Platform you confirm that you meet this requirement and that the information you provide is true and accurate.
2. What Storeflea Mart does
Storeflea Mart is a discovery and lead-generation platform only. It lets you browse products listed by independent local shops, filter by location and rating, and contact a shop that interests you. When you contact a shop, we pass your name, phone number and enquiry to that shop so it can respond to you directly.
Storeflea Mart does not provide a shopping cart, checkout, online payment, order processing, delivery or any transaction facility. Storeflea is not a seller, buyer, agent or party to any dealing between you and a shop.
3. Your account
You sign in to Storeflea Mart using your Google account. You are responsible for maintaining the confidentiality of your login and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
4. Dealings with shops are between you and the shop
Shops on Storeflea Mart are independent third-party businesses. Storeflea does not own, operate, endorse or guarantee any shop, and does not verify, warrant or take responsibility for:
the accuracy, availability, quality, safety, legality or pricing of any product or listing;
any communication, offer, quote, sale, delivery, refund, warranty or after-sale service; or
the conduct of any shop or shopkeeper.
Any transaction, dispute or claim arising from your dealing with a shop is solely between you and that shop. You engage with shops at your own discretion and risk.
5. Acceptable use
You agree not to:
use the Platform for any unlawful, fraudulent, harmful or abusive purpose;
submit false, misleading, spam or nuisance enquiries, or harass any shop;
impersonate any person, or provide a phone number or identity that is not yours;
scrape, harvest, copy or reverse-engineer the Platform, its data or listings;
upload viruses or malicious code, or attempt to disrupt or gain unauthorised access to the Platform;
infringe the intellectual property or privacy rights of Storeflea, any shop or any third party.
6. Enquiries and communications
By contacting a shop you consent to your name, phone number and enquiry being shared with that shop, and to receiving responses from it and service messages from us, including via WhatsApp. Only submit an enquiry if you are comfortable with the shop receiving these details.
7. Intellectual property
The Platform, including the "Storeflea Mart" and "Storeflea" names, logos and trademarks, and all software, design and content we provide, is owned by or licensed to Storeflea and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial discovery purposes. All other rights are reserved. Product listings and shop content belong to the respective shops.
8. Disclaimers
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error-free operation. We do not warrant that any shop, product or listing will meet your expectations.
9. Limitation of liability
To the maximum extent permitted by law, Storeflea and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your dealings with any shop, your reliance on any listing, or your use of or inability to use the Platform. Because Storeflea Mart is a free discovery service and not a party to any transaction, our total aggregate liability, if any, shall not exceed INR 1,000. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Indemnity
You agree to indemnify and hold harmless Storeflea from any claim, loss, liability or expense (including legal fees) arising from your use of the Platform, your enquiries or dealings with shops, or your breach of these Terms or of any law.
11. Suspension and termination
We may suspend, restrict or terminate your access at any time if you breach these Terms or misuse the Platform, or as required by law. You may stop using Storeflea Mart and delete your account at any time from within the app. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) survive termination.
12. Governing law and grievance redressal
These Terms are governed by the laws of India. Subject to applicable law, the courts at [[JURISDICTION_CITY]] shall have exclusive jurisdiction. In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, the name and contact details of our Grievance Officer are published below and in our Privacy Policy. We aim to acknowledge grievances within 48 hours and resolve them within the timelines prescribed by law.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where required, ask you to re-accept within the app before you continue using Storeflea Mart. Continued use after changes means you accept the revised Terms.
